Please read the following Terms of Use (“Terms”) carefully before using the Cravies LLC (“Cravies,” “we,” “our,” or “us”) website located at https://trycravies.com, purchasing any Cravies product (the “Products”), or participating in any online features, services, and programs offered by us (collectively, the “Web Properties”). These Terms apply to all of our Web Properties and Products.
By accessing or using the Web Properties, you agree to be bound by these Terms and all additional terms incorporated by reference. If you do not agree, you should not access or use the Web Properties.
1. Convenience and Information Only
Subject to these Terms, we grant you a non-transferable, non-exclusive, limited license to use and access the Web Properties for personal and non-commercial purposes. The Web Properties are provided for convenience and informational use only. We do not guarantee that content is accurate, current, or error-free. Your use is at your own risk.
2. Web Properties Use and Content
Ownership of all content remains with Cravies. You may view, copy, or print for personal use only, without removing copyright notices. You may not reproduce, reverse engineer, data mine, attempt unauthorized access, or use the Web Properties for unlawful purposes.
3. Updates
We may change the Web Properties, Products, or these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.
4. Privacy and Electronic Communication
By using the Web Properties, you consent to receive communications from us electronically. You agree that such communications satisfy legal requirements.
5. User Account and Security
You may be required to create an account. You are responsible for keeping your login secure. Cravies cannot guarantee that transmissions over the Internet are fully secure.
6. Objectionable Material
You may encounter content you find offensive. You agree to use the Web Properties at your sole risk and waive any liability against Cravies for such content.
7. Age Requirements
The Web Properties are not intended for children under 13. By using them, you confirm that you are at least 18 years old or an emancipated minor with legal capacity.
8. Disclaimers
The Web Properties and Products are provided “as is.” We disclaim all warranties to the fullest extent permitted by law. You agree to indemnify and hold Cravies harmless from any claims arising from misuse or breach of these Terms. Products may contain or come into contact with allergens such as milk, wheat, soy, peanuts, or tree nuts. Always read ingredient labels and consult your physician before making dietary changes.
9. Limitation of Liability
Cravies shall not be liable for indirect, incidental, or consequential damages. Our maximum liability shall not exceed the total amount paid for the Product in question.
10. Payment
(a) General. Products may be purchased as a one-time order or via subscription. Payments are processed through a third-party provider.
(b) Subscription Service. By subscribing, you authorize recurring charges to your selected payment method at the chosen interval (14, 30, or 60 days) until canceled.
(c) Billing Information. You agree to keep your billing information accurate and up to date. Failed payments may result in suspension or cancellation of your subscription.
(d) Cancellation Policy. You may cancel at any time through your account or by contacting hello@trycravies.com. Orders already marked as “Processing” or “Shipped” cannot be canceled.
(e) Refunds and Credits. All sales are final. Because our cereals are food products made for consumption, we do not accept returns or issue refunds once an order has shipped.
If your order arrives damaged or defective, please contact our team within 7 days of delivery at hello@trycravies.com with your order number and clear photos of the issue. Once reviewed and approved, we will send a replacement order at no cost to you.
Please note that we do not offer monetary refunds under any circumstances. Replacements are only provided for items that are damaged or defective upon arrival.
11. Third-Party Content and Applications
The Web Properties may contain links to third-party content. Cravies is not responsible for such content. Use at your own risk.
12. Intellectual Property
All trademarks, logos, and content on the Web Properties are owned or licensed by Cravies. You may not use them without written permission.
13. Copyright Complaints (DMCA)
If you believe your copyright has been infringed, contact us with a written DMCA notice. Counter-notifications may also be submitted as permitted by law.
14. Interactive Services and User Content
By posting or tagging Cravies on social media, you grant us a worldwide, royalty-free license to use your content for marketing and promotional purposes.
15. Termination of Service
We may suspend or terminate your account or access at any time if we believe you violated these Terms.
16. Additional Remedies
We may seek injunctive or equitable relief if your conduct causes harm to Cravies or its reputation.
17. Dispute Resolution
These Terms are governed by the laws of the State of Delaware.
Informal Resolution. Contact hello@trycravies.com first to attempt to resolve any dispute. Agreement to Arbitrate. You and Cravies agree to binding arbitration under the rules of the American Arbitration Association (AAA). No Class Actions. Disputes may only be resolved on an individual basis. Judicial Forum. If arbitration is not applicable, disputes shall be brought exclusively in the courts of Delaware.
18. Local Laws
Accessing the Web Properties from outside the U.S. is at your own risk. You are responsible for complying with local laws.
19. Export Restrictions
Products and technology may be subject to U.S. export laws. You agree not to export or re-export in violation of those laws.
20. SMS/MMS Mobile Marketing
By opting into our SMS program, you agree to receive recurring marketing texts from Cravies. Message frequency varies and message and data rates may apply. You can opt out anytime by replying STOP, END, CANCEL, or UNSUBSCRIBE. For help, reply HELP or email hello@trycravies.com. Consent to receive text messages is not a condition of purchase.
21. Miscellaneous
Failure to enforce any right under these Terms does not constitute a waiver. If any provision is held invalid, the remaining Terms will remain in effect.
22. Your Consent to These Terms
By using the Web Properties, you agree to these Terms. Updates will be posted on this page as needed.
